BigObject Private Limited (hereinafter referred to as ‘BigObject’) will provide the Aralia product website www.araliadata.io regarding the cloud data planet service (Aralia Data Planet) and the data content provided (hereinafter collectively referred to as ‘the Service’) in accordance with the following terms (hereinafter referred to as ‘Terms of the Service’) for the users of the Service (hereinafter referred to as ‘you’).When you start using the Service, you are deemed to have read, understood and agree to abide by all posted or referenced guidelines, policies, rules or Terms of the Service. If you do not agree to the contents of these Terms of Service, you should immediately stop using the Service. BigObject has the right to modify or change the content of these Terms of Service at any time and announce it on the Aralia product website. Please pay attention to such modifications or changes at any time. If you continue to use the Service after any modification or change, you will be deemed to have read, understood and agreed to accept the modification or change.

1. Agreement with BigObject

1.1. These Terms of Service constitute a legal agreement between you and BigObject and apply to your use of the Service.
1.2. By beginning to use all or any portion of the Service, you signify that you have read, understood, and agreed to:
1. The privacy statement, intellectual property statement, and other related terms and conditions within these Terms of Service;
2. These Terms of Service have the same effect as any written agreement signed by you;
3. You are bound by all the terms and conditions in these Terms of Service as a matter of law;

2. You are a direct competitor of the Service or your use of the Service is for monitoring its availability, performance, or functionality, or for any other benchmarking or competitive purposes.

1.6. You understand and agree that, unless otherwise provided in these Terms of Service, you shall not download, reproduce, modify, display, perform, transfer, distribute, or otherwise use the service, and you agree to take all reasonable measures to prevent unauthorized use of the Service.

2. Service Description

2.1. Unless otherwise explicitly stated, any new features added to or enhancing the current service, including new versions, shall be subject to the terms and conditions of the Service or any other applicable terms of Service.
2.2. You understand and agree that BigObject may modify, terminate, suspend, or adjust any and all features, characteristics, options, tools, or other aspects of the Service at any time without prior notice to you.
2.3. You are responsible for all necessary equipment and networks (including associated fees such as internet charges) to access and use the Service.
2.4. You are not obligated to provide BigObject with ideas, suggestions, requests, corrections, proposals, or other feedback (hereinafter referred to as ‘Feedback’). However, by submitting Feedback to us, you acknowledge and agree that:
1. You grant BigObject a worldwide, perpetual, irrevocable, royalty-free license and permission to use your Feedback as a contribution to the Service.
2. BigObject may use your Feedback for any purpose without compensating you.
3. All rights, ownership, and interests in any products or services created by BigObject based on your Feedback shall be the exclusive property of BigObject.
4. Your Feedback do not contain any confidential, non-public, or proprietary information of any third-party companies, and shall not violate or infringe upon any rights of these third parties.
5. BigObject has no obligation of confidentiality with respect to your Feedback.
6. BigObject has the right to use or disclose your Feedback in any manner and for any purpose on a global scale and in any media without any fee or obligation.
7. You have no right to receive any form of compensation or reimbursement from BigObject under any circumstances.
2.5. You fully understand and agree that the Service is not compliant with the Payment Card Industry Data Security Standard (PCI DSS).

3. Use of Service

3.1. You agree not to use the Service to:
1. Interfere with or disrupt the Service or servers or networks connected to the Service; or
2. ‘Stalk’ or otherwise harass others; or
3. Engage in reverse engineering, decompile, disassemble, or otherwise attempt to discover the source code of the Service provided in object code form; or
4. Copy, use, reproduce, distribute, redistribute, download, display, post, or transmit any data regarding the Service in any form or by any means.
3.2. You understand and agree that BigObject may access or disclose your account information if (1) required by law or regulations from competent agency; or (2) to enforce the Terms of Service; or (3) to protect the rights, property, or personal safety of BigObject, its users, and the public.
3.3. You understand and agree that BigObject may establish general practices and limits concerning the use of the Service, including but not limited to the maximum number of days that the content will be retained by the Service, the maximum number of times (and the maximum duration) you may access the Service in a given period, and/or any other conditions of the Service.

4. Data Usage

4.1. The Service include publicly available data produced by third parties (‘Open Data’). You understand and agree that when you use such data, you are subject to any terms of service, conditions, and privacy policies applicable to the data provider.
4.2. BigObject expressly disclaims any and all representations or warranties regarding any Open Data produced by third parties.
4.3. BigObject shall not be liable for any liabilities or obligations arising from the use or inability to use any Open Data produced by third parties. However, disclaimers, limitations, and other terms applicable regarding the production of Open Data by third parties shall remain in effect to BigObject.
4.4. Any information, data, content, or other materials obtained through the Service are provided on an ‘as is’ and ‘as available’ basis. BigObject expressly disclaims any form of express or implied warranties, including but not limited to warranties of merchantability, ownership, fitness for a particular purpose, and non-infringement.

5. Data Owner

5.1. You may upload and publish data through the Service, and authorize third parties to view the data.
5.2. BigObject expressly states that you are the owner of the data uploaded to the Service. You are responsible for the content uploaded to the Service, including quality, authenticity, completeness, reliability, and non-infringement.
5.3. You understand and agree that the data you publish is your responsibility. You should be careful about the data you choose to publish, as it may have certain consequences.
5.4. BigObject expressly states that it protects your data ownership rights, does not provide data download services, and does not make decisions about the content you upload.
5.5. Subject to the requirements of local regulations, BigObject reserves the right (but assumes no obligation) to remove the following content, including:
1. Content that infringes copyrights, trademarks, or other rights and interests of any third party.
2. Obscene content, child pornography, and content depicting the exploitation of children.
3. Content inciting violence, hatred, or any illegal behavior.
4. Content that violates other applicable laws such as current numbers and locations of deployed troops during wartime.
5. Other content that BigObject has reasonable grounds to believe is inappropriate.

6. Privacy Statement

6.1 When you use and interact with our website or the Service, provide Feedback, communicate with us, or participate in our activities, we may collect, use, and process information related to you (referred to as ‘Personal Data’ below). 7. Intellectual Property Statement

7.1. You understand and agree that the Service and any other software related to Aralia are subject to the protection of intellectual property rights and other relevant laws and regulations.
7.2. The trademarks, logos, and service marks displayed on the Service are owned by BigObject. You understand and agree not to display or use them in any manner without prior written consent from BigObject.
7.3. The software or programs used in the Service, and all content on the product website (including but not limited to texts, images, files, information, website architecture, website layout, webpage design, etc.), are owned by BigObject or other rights holders in accordance with the relevant laws and regulations (including but not limited to trademark rights, patent rights, copyright, trade secrets, know-how and proprietary technology). No one may use, modify, reproduce, publicly broadcast, adapt, distribute, publish, publicly disclose, reverse engineer, decompile, or disassemble them without authorization in written form.
7.4. Furthermore, you understand and agree that the content included in the Service or provided to you is protected by copyright, trademark, service marks, patents, or other proprietary rights and laws. Unless expressly permitted by applicable law or authorized by BigObject, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the entire or partial content of the Service, BigObject software, or other software or materials.

If you intend to quote or reproduce the aforementioned software, programs, or website content, you must obtain prior written consent and formal authorization from BigObject or other rights holders in accordance with the law. Respecting intellectual property rights is your obligation, and if any infringement causes damage to BigObject, you shall be liable for damages to BigObject (the scope of compensation includes but is not limited to litigation costs and attorney’s fees).
7.6. The Service may contain or provide components licensed from third parties (‘Third Party Code’), including components subject to ‘open source’ software license terms and conditions (‘Open Source Software’). Open Source Software may be identified in a list of Open Source Software provided to you upon written request. To the extent required by the terms of the licenses accompanying Open Source Software, such license terms shall govern the use of such components in lieu of the terms of this Agreement, including but not limited to any provisions regarding access to, modification of, or reverse engineering of the source code.

8. Disclaimer and Limitation of Liability

8.1. You expressly understand and agree that:
1. You assume all risks associated with your use of the Service (including any information, data, content, or other materials obtained through the Service);
2. BigObject does not guarantee that (a) the Service will meet all your requirements, (b) the Service (including systems and data) will be uninterrupted, timely, secure, or error-free, (c) the results obtained from the use of the Service will be accurate or reliable, (d) the quality, authenticity, completeness, timeliness, or reliability of any data, (e) the services, data, content, information, or other materials obtained through the Service will meet your expectations, and (f) any errors in the Service will be corrected.
8.2. The Service strives to maintain the stability and security of the system. However, in the event of force majeuresuch as unforeseen natural disasters or human-induced incidents resulting in system interruptions or malfunctions, and thereby causing inconvenience, data loss, errors, unauthorized alterations, or other economic losses to your usage, you expressly understand and agree that the website bears no liability for any compensation.
8.3. You expressly understand and agree that for the following reasons, BigObject shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of reputation, loss of use, loss of data, or other intangible losses (even if they have been advised of the possibility of such damages):
1. Use or inability to use the Service, including any information, data, content, or other materials obtained through the Service; or
2. Costs of procurement of substitute goods and services resulting from any goods, data, information, or services obtained through the Service or transactions entered into, or messages received, or transactions undertaken through the Service; or
3. Unauthorized access or alteration of your transmissions or data; or
4. Any third-party statements or conduct on the Service; or
5. Any other matter related to the Service. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Therefore, some of the limitations in this section may not apply to you.

9. Compensation

9.1. You expressly understand and agree to indemnify BigObject, and hold it harmless against any claims or demands made by any third party arising out of the following reasons, including reasonable attorney fees: (a) your improper use of the Service; (b) your violation of the Terms of Service; (c) your infringement of any third-party rights resulting in claims against BigObject by such third parties.

10. Termination

10.1. You expressly understand and agree that BigObject may terminate your account on the Service immediately and revoke access to the Service and/or any and all content, features, or materials therein, without prior notice, in any circumstances. Such termination may occur for reasons including, but not limited to:
1. Violation of the Terms of Service or any other guidelines, policies, rules, or terms published or referenced by BigObject;
2. Requests from law enforcement agencies or other governmental authorities;
3. Your request (self-initiated account deletion);
4. Interruption or significant modification of the Service (or any part thereof);
5. Unexpected technical or security issues;
6. Prolonged inactivity of your account;
7. Engagement in fraudulent or illegal activities.
10.2. You expressly understand and agree that the termination of your BigObject account includes:
1. Revocation of access permissions to all products within the Service;
2. Deletion of your password and all related information, files, and content associated with your account (or any part thereof);
3. Prohibition from further use of the Service.
10.3. Furthermore, you understand and agree that BigObject shall not be liable to you or any third party for any consequences arising from the termination of your account, any associated email addresses, or access to the Service or content (including any limited versions).

11. Revision

11.1. The Terms of Service may be revised periodically, and if we make any material changes, we will notify you by sending an email to the last email address you provided to us (if any), and/or prominently posting a notice of changes on our website.
11.2. Any revisions to the Terms of Service will take effect within 30 calendar days after we post a notice of changes on our website. By continuing to use our services after receiving such change notifications, you acknowledge and agree to be bound by the terms and conditions of such changes.

12. Registration Obligations

12.1. In order to access or use certain services, you may be required to provide certain information about yourself (‘Registration Data’) as part of the registration process for this service, or as part of your continued use of this service. The provisions regarding registration obligations set forth in Article 6 of the Privacy Policy shall apply mutatis mutandis.

2. You will maintain and promptly update the Registration Data to keep it truthful, accurate, current, and complete.
12.3. You understand and agree that the Service may include certain communications from BigObject, such as service announcements and administrative messages, and you may not be able to opt out of receiving them.

If any information about Registration Data provided by you is untrue, inaccurate, not current, or incomplete, BigObject reserves the right to suspend or terminate your account, block your access to any or all parts of the service and/or content (or other users’ access to your content), and refuse any and all current or future use of the service (or any portion thereof) or content.

13. Accounts, Passwords and Security

13.1. As part of your use of the Service, you may receive passwords and account names upon completing the registration process. You are responsible for maintaining the confidentiality of your password and account, and you are fully responsible for all activities that occur under your password or account. You agree to:

Immediately notify BigObject of any unauthorized use of your password or account or any other breach of security;
Ensure that you log out of your account at the end of each session.

13.2. BigObject shall not be liable for any loss or damage arising from your failure to adequately protect your account or password. You are solely responsible for adequately protecting and backing up any type of content you upload, download, or otherwise create or use with the Service and/or devices related to the Service.

15. Governing Law and Jurisdiction

In the event of any disputes arising from the Service or the Terms of Service, you agree that the laws and regulations of the Republic of China(R.O.C.) shall apply, and the Taipei District Court of Taiwan shall have exclusive jurisdiction as the court of first instance.
